Zucchiny Pet Network
Welcome to Zucchiny Pet Network. The following Terms and Conditions ("Terms") regulate the relationship between Zucchiny, Corp. (D-U-N-S: 481018659; herein "Zucchiny", "we", "us") and persons accessing or using the Zucchiny Pet Network platform ("Platform") as visitors or registered users ("you", "user").
By accessing or using the Platform, you agree to these Terms. You must be at least 15 years old to use the Platform. If you are under 18, you confirm that you have permission from a parent or legal guardian.
1. The Platform
1.1 Zucchiny Pet Network is a platform that connects users for pet-related services and exchanges.
1.2 Browsing is available without registration. Active participation such as creating listings or contacting other users requires registration.
1.3 Certain features, listings, or transactions may be subject to fees or commissions. Fees may vary based on factors such as listing location and duration, and may be set in different currencies for different markets. Applicable fees are disclosed before you incur them.
1.4 Zucchiny reserves the right to modify, suspend, or discontinue any part of the Platform at any time.
2. User Conduct
2.1 Users agree to use the Platform lawfully and in accordance with these Terms.
2.2 Users are responsible for the accuracy of information they provide.
2.3 Users agree not to engage in conduct that is harmful, fraudulent, deceptive, or that violates the rights of others.
3. Content
3.1 Users retain ownership of content they post on the Platform.
3.2 By posting content, users grant Zucchiny a worldwide, royalty-free, non-exclusive license to use, display, distribute, and promote the content in connection with the Platform.
3.3 Zucchiny may review, modify, remove, or adjust the visibility of any content at its discretion, without prior notice.
3.4 Users may not post unlawful, abusive, harassing, defamatory, or otherwise objectionable content. Violation may result in account and/or content removal.
3.5 Zucchiny is not obligated to refund fees or commissions paid for listings or other content, including in cases where content is removed or accounts are suspended.
3.6 All content provided by Zucchiny is protected by copyright.
4. Plans, Listing Credits, and Promotions
4.1 Plans, listing credits, and promotions are optional benefits Zucchiny may make available. They are provided at our discretion and do not form a guaranteed or permanent entitlement.
4.2 Zucchiny may introduce, change, suspend, or discontinue plans, listing credits, and promotions, including how they work, their scope, the benefits they confer, and the terms on which they are provided. Where their workings change, we will make reasonable efforts to update our related documentation.
4.3 Listing credits are a platform benefit. They have no monetary value, are not a deposit or stored funds, are not redeemable or exchangeable for cash, and do not represent a claim to money. Credits may expire, may be limited in scope, and may be adjusted, withheld, or withdrawn, whether as a service decision by Zucchiny or in cases of abuse, fraud, error, or where required by law. Zucchiny does not guarantee the delivery or continued availability of any credits.
4.4 A grant, whether a plan, credits, or a promotion, applies only as and for the period stated, and unless renewed or extended ends at the close of that period, after which the associated benefits cease.
4.5 Zucchiny may deny, withhold, or revoke any plan, credits, or promotion, and may remove such benefits from a user at its discretion as a service decision, or where reasonably necessary. This includes cases of suspected or actual harmful behavior, abuse, fraud, platform harm, violation of these Terms, account suspension or termination, or where required by law.
4.6 Listing credits are denominated in a currency of Zucchiny's selection. Where credits are applied against a fee set in another currency, or where amounts are displayed in another currency, Zucchiny performs the currency conversion. The exchange rates used, their source and timing, rounding, and the manner of conversion and deduction are determined by Zucchiny at its sole discretion and may differ from market or interbank rates. Zucchiny may also decline to convert or apply credits from certain currencies to certain others. Displayed converted amounts are indicative and may differ from the amounts ultimately applied.
5. Liability
5.1 Zucchiny, Corp. will not become a contractual partner nor arbitrator should any arrangement be formed between users. In particular, Zucchiny, Corp. accepts no responsibility for damages or disputes arising from contacts made through the platform.
5.2 Zucchiny, Corp. accepts no responsibility to guarantee the quality, accuracy, or legitimacy of any listing, user generated content or arrangement made through the platform. Users are responsible for complying with applicable laws and regulations, verifying the suitability of other users, and maintaining appropriate insurance if applicable.
5.3 Zucchiny, Corp. does not guarantee the authenticity of users, accounts, conversations, or messages. All arrangements between users are made at their own risk.
5.4 Zucchiny, Corp. does not guarantee uninterrupted access, completeness, or reliability of the service.
5.5 The Platform is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied.
5.6 To the maximum extent permitted by law, Zucchiny's total aggregate liability arising out of or relating to the Platform shall not exceed the total fees you paid to Zucchiny in the twelve (12) months preceding the event giving rise to the claim, or CHF 100, whichever is greater.
5.7 You agree to indemnify and hold harmless Zucchiny, Corp., its officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, your conduct toward other users, or your violation of these Terms or applicable law.
6. Termination
6.1 Registered users may delete their account at any time.
6.2 Zucchiny may suspend or terminate accounts at its discretion, without prior notice.
7. General Provisions
7.1 Zucchiny reserves the right to modify these Terms at any time. Users will be informed of changes in an appropriate manner.
7.2 Swiss law is applicable to the relationship between the user and Zucchiny, Corp.
7.3 For users residing in Switzerland, disputes may be brought at their place of residence.
